JCURVEIQ — TERMS OF USE

1. Acceptance of Terms

These Terms of Use (“Terms”) govern your access to and use of the public website located at jcurveiq.com and any related pages, content, forms, materials, or resources made available through the website (the “Site”).
By browsing, clicking a link, submitting a form, requesting a demo, downloading materials, or otherwise using the Site, you (“Visitor,” “you,” or “your”) accept and agree to be bound by these Terms and our Privacy Policy.
If you do not agree to these Terms, you must not access or use the Site.

2. Who We Are

“JcurveIQ” is a trade name operated by Jcurve Technologies LLC, a Wyoming limited liability company registered in the State of Wyoming, United States.
In these Terms, “JcurveIQ,” “we,” “us,” and “our” refer to Jcurve Technologies LLC, doing business as JcurveIQ.

Note: The SaaS platform itself may be governed by a separate End-User License Agreement (“EULA”), customer agreement, order form, Data Processing Addendum (“DPA”), or other written agreement between JcurveIQ and the applicable customer.
These Terms apply only to the public Site, unless a separate agreement expressly states otherwise.

3. Changes to the Terms

We may revise these Terms at any time by posting an updated version on the Site and changing the “Last updated” date above.
Material changes become effective 30 days after we post them, unless a shorter period is required by law or the change is made for security, legal, or operational reasons.
Your continued use of the Site after the updated Terms become effective constitutes acceptance of the revised Terms.
If you do not agree to the revised Terms, you must stop using the Site.

4. Permitted Use of the Site

You may view pages, download publicly available PDFs or materials, review product information, and use the “Request Demo” form solely for legitimate business evaluation of JcurveIQ’s products and services.
You must not:

  • copy, scrape, frame, mirror, reproduce, or redistribute any part of the Site except for standard search-engine caching;

  • use bots, crawlers, spiders, scrapers, data-mining tools, automated scripts, or other automated means to access, monitor, extract, or copy Site content;

  • upload, transmit, or introduce malware, viruses, worms, logic bombs, harmful code, automated scripts, or data-harvesting tools;

  • bypass, disable, damage, interfere with, or attempt to circumvent any security, authentication, rate-limiting, access-control, or usage-monitoring features;

  • attempt to gain unauthorized access to any portion of the Site, our systems, our networks, or any connected infrastructure;

  • use the Site to advertise, promote, solicit, or market competing products or services;

  • misrepresent your identity, company, employer, job title, authority, or affiliation with any organization;

  • submit false, misleading, fraudulent, unlawful, abusive, or harmful information through the Site;

  • use the Site in a way that violates applicable laws, regulations, sanctions, export controls, or third-party rights;

  • ​interfere with the normal operation, availability, security, or performance of the Site;

  • use the Site for unlawful, fraudulent, deceptive, abusive, harassing, or harmful purposes.

We reserve the right to suspend, restrict, block, or terminate access to the Site at any time if we believe your use violates these Terms, creates risk, causes harm, or may expose JcurveIQ, our users, or third parties to liability.​

5. Intellectual-Property Rights

All content on the Site, including text, graphics, logos, icons, screenshots, videos, images, software, code, product names, designs, page layouts, user interface elements, downloadable materials, and the overall “look and feel” of the Site, is owned by Jcurve Technologies LLC, its affiliates, or its licensors.
The Site and its content are protected by copyright, trademark, trade dress, database, unfair competition, and other intellectual property laws in the United States and other jurisdictions.
Subject to your compliance with these Terms, we grant you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to access and view the Site content solely for the Site’s intended purpose.
This license does not allow you to:

  • copy, modify, distribute, sell, lease, sublicense, or commercially exploit Site content;

  • create derivative works from Site content;

  • remove copyright, trademark, or proprietary notices;

  • use Site content to build or improve a competing product or service;

  • reverse engineer, decompile, disassemble, or attempt to extract source code from any part of the Site;

  • use our materials in a way that suggests sponsorship, endorsement, or affiliation without our written permission.

Nothing in these Terms transfers ownership of any intellectual property rights to you.
All rights not expressly granted are reserved by Jcurve Technologies LLC.

6. Feedback and Submitted Materials

If you send us ideas, suggestions, comments, product requests, improvement ideas, demo-request comments, or other feedback (“Feedback”), you grant Jcurve Technologies LLC a perpetual, worldwide, irrevocable, transferable, sublicensable, royalty-free license to use, copy, modify, adapt, publish, distribute, display, perform, commercialize, and incorporate that Feedback into our products, services, marketing, operations, and business without restriction or compensation to you.
You agree that:

  • Feedback is provided voluntarily;

  • we may use Feedback without obligation to you;

  • we are not required to keep Feedback confidential;

  • we are not required to implement Feedback;

  • Feedback does not create any ownership right, compensation right, or partnership right for you.

Please do not send confidential, proprietary, sensitive, regulated, or personal financial information through public forms on the Site.

7. Third-Party Links

The Site may contain links to third-party websites, services, platforms, articles, tools, integrations, or resources.
We do not control, endorse, monitor, or assume responsibility for any third-party websites or services.
Third-party websites may have their own terms, privacy policies, security practices, and data collection practices.
You access third-party websites at your own risk.
We are not responsible for any loss, damage, liability, or issue arising from your use of third-party websites or services.

8. No Professional or Investment Advice

Site content is provided for general informational, educational, marketing, and product-description purposes only.
Nothing on the Site constitutes or should be interpreted as:

  • investment advice;

  • financial advice;

  • legal advice;

  • accounting advice;

  • tax advice;

  • compliance advice;

  • securities research;

  • a recommendation to buy, sell, hold, or trade any security;

  • an offer to sell or solicitation of an offer to buy any security, financial product, or investment product;

  • a substitute for independent professional judgment.

9. Generative-AI Disclosures

Blog posts, product descriptions, examples, demos, screenshots, videos, marketing materials, research examples, or other Site content may reference, describe, display, or include AI-generated content.
AI outputs can be inaccurate, incomplete, outdated, misleading, biased, or unsuitable for a specific use case.
You acknowledge and agree that:

  • AI-generated content should not be relied on without human review;

  • you are solely responsible for verifying any AI output before relying on it;

  • JcurveIQ does not guarantee the accuracy, completeness, reliability, or usefulness of AI-generated content shown on the Site;

  • examples, demos, and screenshots are illustrative only and may not reflect actual product performance in every situation;

  • AI tools may produce different outputs depending on inputs, documents, prompts, data quality, and system configuration.

You bear sole responsibility for reviewing, validating, and verifying any result, output, summary, insight, citation, or analysis before using it for business, investment, financial, legal, accounting, tax, compliance, or other professional purposes.

10. Disclaimer of Warranties

THE SITE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.”
TO THE MAXIMUM EXTENT PERMITTED BY LAW, JCURVE TECHNOLOGIES LLC, DOING BUSINESS AS JCURVEIQ, DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WARRANTIES OF:

  • MERCHANTABILITY;

  • FITNESS FOR A PARTICULAR PURPOSE;

  • TITLE;

  • ACCURACY;

  • COMPLETENESS;

  • NON-INFRINGEMENT;

  • QUIET ENJOYMENT;

  • UNINTERRUPTED AVAILABILITY;

  • SECURITY;

  • ERROR-FREE OPERATION;

  • RELIABILITY;

  • SUITABILITY FOR YOUR BUSINESS OR USE CASE.

We do not warrant that:

  • the Site will always be available;

  • the Site will be uninterrupted or error-free;

  • defects will be corrected;

  • the Site will be free of viruses, malware, or harmful components;

  • Site content will be accurate, complete, current, or reliable;

  • any product description, demo, screenshot, example, or marketing claim will match your actual results;

  • the Site will meet your requirements or expectations.

You use the Site at your own risk.

11. Limitation of Liability

a. Liability Cap
To the maximum extent permitted by law, Jcurve Technologies LLC’s total liability arising out of or related to the Site, these Terms, Site content, or your use of the Site shall not exceed USD $100.
b. Exclusion of Damages
To the maximum extent permitted by law, Jcurve Technologies LLC, its owners, members, managers, officers, employees, contractors, advisors, affiliates, licensors, service providers, and agents will not be liable for any:

  • indirect damages;

  • consequential damages;

  • special damages;

  • incidental damages;

  • punitive damages;

  • exemplary damages;

  • lost profits;

  • lost revenue;

  • lost business opportunities;

  • lost goodwill;

  • loss of data;

  • business interruption;

  • investment losses;

  • trading losses;

  • losses arising from reliance on Site content;

  • losses arising from AI-generated content;

  • losses arising from third-party websites or services.

This limitation applies even if we have been advised of the possibility of such damages.
Some jurisdictions do not allow certain exclusions or limitations of liability. In such cases, liability will be limited to the smallest amount permitted by applicable law.

12. Indemnification

You agree to indemnify, defend, and hold harmless Jcurve Technologies LLC, doing business as JcurveIQ, and its owners, members, managers, officers, employees, contractors, advisors, affiliates, licensors, service providers, and agents from and against any claim, demand, dispute, loss, damage, liability, judgment, settlement, cost, or expense, including reasonable attorneys’ fees, arising out of or relating to:

  • your breach of these Terms;

  • your misuse of the Site;

  • your violation of applicable law;

  • your violation of third-party rights;

  • your submission of false, misleading, confidential, sensitive, unlawful, or harmful information;

  • your unauthorized use of Site content;

  • your use of the Site for competitive, abusive, fraudulent, or unlawful purposes;

  • your reliance on Site content, demos, examples, or AI-related materials.

We reserve the right to assume the exclusive defense and control of any matter subject to indemnification, and you agree to cooperate with our defense of such claims.

13. Local-Law Compliance & Export Controls

You are responsible for complying with all local, state, national, and international laws that apply to your use of the Site.
The Site, downloadable materials, software descriptions, white papers, documentation, and related content may be subject to U.S. export-control laws, sanctions laws, and trade restrictions.
You agree not to access, use, export, re-export, transfer, or make available any Site content or related materials in violation of applicable export-control laws, sanctions, or trade restrictions.
You may not use the Site if you are:

  • located in a country or region subject to comprehensive U.S. sanctions;

  • organized under the laws of a sanctioned country or region;

  • ordinarily resident in a sanctioned country or region;

  • listed on any restricted party, denied party, blocked person, or sanctions list;

  • using the Site for prohibited military, nuclear, chemical, biological, surveillance, or unlawful purposes.

We may restrict or deny access to the Site where required by law or where we believe access may create legal, regulatory, security, or sanctions risk.

14. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Wyoming, United States, without regard to conflict-of-law rules.
Before bringing a formal claim, you agree to contact us at hello@jcurveiq.com and attempt to resolve the dispute informally.
If the dispute cannot be resolved informally, any dispute, claim, or controversy arising out of or relating to these Terms, the Site, Site content, or your use of the Site shall be resolved through binding arbitration, unless applicable law provides otherwise.
The arbitration shall be conducted on an individual basis.
Class actions, class arbitrations, representative actions, collective actions, and consolidated proceedings are not permitted to the maximum extent allowed by law.
Either party may seek injunctive or equitable relief in any court of competent jurisdiction to protect intellectual property, confidential information, security interests, or unauthorized use of the Site.
Some jurisdictions may not allow mandatory arbitration or class-action waivers. In such cases, this section will apply only to the maximum extent permitted by law.

15. Termination

We may suspend, restrict, block, or terminate your access to the Site at any time, with or without notice, for conduct that we believe:

  • violates these Terms;

  • violates applicable law;

  • creates legal, regulatory, security, or operational risk;

  • is harmful to other users, third parties, or JcurveIQ;

  • interferes with the operation, security, or availability of the Site;

  • misuses Site content or intellectual property;

  • is fraudulent, abusive, deceptive, or unlawful.

Termination or suspension does not limit any other rights or remedies available to us.
Sections that by their nature should survive termination will survive, including intellectual property, feedback, disclaimers, limitation of liability, indemnification, governing law, dispute resolution, and miscellaneous provisions.

16. Miscellaneous

Entire Agreement - These Terms and the Privacy Policy constitute the entire agreement between you and Jcurve Technologies LLC regarding use of the Site.
If you are a customer or authorized user of the JcurveIQ SaaS platform, your use of the software platform may also be governed by a separate EULA, customer agreement, order form, DPA, or other written agreement.
Severability - If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions will remain in full force and effect.
The invalid or unenforceable provision will be interpreted or replaced to achieve the original intent as closely as permitted by law.
Force Majeure - Neither party will be liable for delays or failures caused by events beyond reasonable control, including natural disasters, acts of God, war, terrorism, labor disputes, internet backbone failures, hosting outages, cyberattacks, government actions, pandemics, power failures, or other events outside reasonable control.
No Waiver - Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.
A waiver is effective only if made in writing by an authorized representative of Jcurve Technologies LLC.
Assignment -You may not assign or transfer your rights or obligations under these Terms without our prior written consent.
We may assign or transfer these Terms in connection with a merger, acquisition, financing, restructuring, sale of assets, change of control, or by operation of law.
Relationship of the Parties - Nothing in these Terms creates a partnership, joint venture, agency, employment, fiduciary, or franchise relationship between you and Jcurve Technologies LLC.
Headings - Headings are included for convenience only and have no legal effect.

Schedule 1: Data Processing Notice for Website Visitors

​This Schedule 1 provides additional information about how personal data submitted through the public website is handled.

1. Role
For personal data you submit through the “Request Demo” form, contact forms, or similar website interactions, Jcurve Technologies LLC, doing business as JcurveIQ, acts as a data controller under the GDPR/UK GDPR and as a business under the CCPA/CPRA, where those laws apply.
This Notice applies only to the public marketing Site.
Customers who create platform accounts, receive product access, upload documents, or use the JcurveIQ SaaS platform may be covered by a separate Data Processing Addendum, EULA, customer agreement, or other written contract.

2. Data Collected
We may collect the following information from website visitors:

  • name;

  • corporate email address;

  • phone number;

  • company name;

  • job title or role;

  • message or demo request details;

  • IP address;

  • browser and device information;

  • event logs, including page views, clicks, timestamps, and form submissions;

  • first-party cookie information, if applicable.

We do not intentionally collect sensitive personal data through public website forms.
You should not submit confidential, regulated, sensitive, or personal financial information through public forms.

​3. Purpose of Processing
We process website visitor data for the following purposes:

  • to respond to demo requests;

  • to contact prospective customers;

  • to understand business interest in JcurveIQ;

  • to improve Site performance;

  • to detect abuse, spam, fraud, or security threats;

  • to maintain internal sales and business records;

  • to comply with applicable legal obligations;

  • to enforce our Terms and protect our rights.

Where GDPR or UK GDPR applies, we rely on the following legal bases:
Article 6(1)(b): Contract or pre-contractual steps When we respond to your demo request or communicate with you about potential use of JcurveIQ.

Article 6(1)(f): Legitimate interests When we process data for B2B marketing, security, fraud prevention, Site improvement, business operations, and responding to inquiries.
Article 6(1)(a): Consent Where consent is required for certain marketing communications or non-essential cookies.
Article 6(1)(c): Legal obligation Where processing is necessary to comply with applicable laws, lawful requests, or regulatory obligations.

5. Retention
We retain website visitor data only as long as reasonably necessary for the purposes described above.
Typical retention periods:

  • raw demo-form submissions: up to 24 months;

  • sales and business communications: as long as needed for legitimate business follow-up or recordkeeping;

  • analytics and event logs: up to 18 months, unless aggregated or anonymized sooner;

  • security logs: as long as reasonably necessary for security, fraud prevention, and operational needs;

  • legal records: as required by applicable law.

You may request deletion by emailing hello@jcurveiq.com, subject to legal, security, compliance, and legitimate business retention needs.

6. Your Rights
Depending on your location, you may have rights to:

  • access your personal data;

  • correct inaccurate personal data;

  • request deletion;

  • restrict processing;

  • object to processing;

  • request portability;

  • withdraw consent where processing is based on consent;

  • opt out of certain uses where applicable;

  • lodge a complaint with a data protection authority.

7. Notice Limitation
This Schedule 1 is for the public marketing Site only.
It does not fully describe processing that may occur inside the JcurveIQ SaaS platform, customer workspaces, uploaded documents, research workflows, AI outputs, or enterprise accounts.
Those activities may be governed by a separate EULA, Data Processing Addendum, customer agreement, order form, or other written agreement.
